General Provisions

  1. This Privacy Policy defines how personal data necessary for the provision of electronic services through the nexusoptima.com website (hereinafter: Service) are collected, processed, and stored.
  2. The Service collects only personal data necessary for the provision and development of services offered within.
  3. Personal data collected through the Service are processed in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation, GDPR) and the Act on the Protection of Personal Data of 10 May 2018.

Purpose of Collecting Personal Data

  1. Personal data is used for:
    – registration of an account and user identity verification,
    – enabling login to the Service,
    – execution of a contract for services and e-services,
    – communication with the User (live chat, contact form, etc.),
    – newsletter distribution (after the User’s consent to receive it),
    – operating a comment system,
    – providing social services,
    – promoting the Nexus Optima’s offer,
    – marketing, remarketing, affiliation,
    – personalizing the Service for Users,
    – analytical and statistical activities,
    – debt collection,
    – establishment and pursuit of claims or defense against them.
  2. Providing data is voluntary but necessary to conclude a contract or use other functionalities of the Service.

Type of Processed Personal Data

Nexus Optima may process User’s personal data: name, date of birth, address, email address, phone number, Tax Identification Number (NIP).

Period of Processing Personal Data

User’s personal data will be processed for:
– if the basis for data processing is contract performance – until the expiry of claims after its performance,
– if the basis for data processing is consent – until its withdrawal, and after withdrawal until the expiry of claims.
In both cases, the limitation period is 6 years, and for claims for periodic benefits and claims related to business activity – 3 years (unless a specific provision states otherwise).

Sharing of Personal Data

  1. User’s personal data may be disclosed to: entities affiliated with the Administrator, its subcontractors, entities cooperating with the Administrator (e.g., companies handling e-payments, courier/postal service companies, law firms).
  2. User’s personal data will not be transferred outside the European Economic Area (EEA).

User Rights

  1. The Service User has the right to: access their personal data, rectify, erase, restrict processing, data portability, object to processing, withdraw consent at any time (without affecting the lawfulness of processing based on consent before its withdrawal).
  2. A User’s request related to the mentioned rights should be sent to admin@nexusoptima.com.
  3. Nexus Optima fulfills or refuses to fulfill the request immediately – within one month from its receipt.
  4. The User has the right to lodge a complaint with the President of the Office for Personal Data Protection if they consider that the processing violates their rights and freedoms (GDPR).

Cookies

  1. The Service collects information through cookies – session, permanent, and from external entities.
  2. Collecting cookies supports the correct provision of services in the Service and serves statistical purposes.
  3. The User can specify the scope of cookie access to their device in the browser settings.

Automated Decision Making and Profiling

  1. User data cannot be processed in an automated manner leading to any decisions concerning them.
  2. User data can be profiled to customize content and personalize offers after obtaining their consent.

Final Provisions

  1. Nexus Optima has the right to introduce changes to the Privacy Policy, ensuring that the rights of Users are not restricted.
  2. Information about introduced changes will be provided in the form of a notification available in the Service.
  3. Matters not regulated in this Privacy Policy are subject to GDPR provisions and Polish law regulations.
